In the Tuesday, July 5, 2011, Federal Register, the EPA noted it is extending the comment period for guidance that will determine where the agency's powers end under the Clean Water Act. On May 2, 2011, the EPA and the U.S. Army Corps of Engineers announced availability of draft guidance (76 FR 24479) that describes how the agencies will identify waters protected by the Clean Water Act of 1972, and implement the Supreme Court's decisions on this topic (i.e., Cook County and Rapanos).
