The EPA announced in the Federal Register on March 30, 2011 that it was taking interim action to extent a previously announced stay of the final rules entitled, Prevention of Significant Deterioration (PSD) and Nonattainment New Source Review (NSR): Reconsideration of Inclusion of Fugitive Emissions (Fugitive Emission Rule) as published in the Federal Register on Dec. 19, 2008.
The Fugitive Emissions Rule under the federal NSR had required that fugitive emissions be included in the determination of whether a physical or operational changed resulted in a major modification only for sources from certain industries. The EPA had issued a stay from the rule on March 31, 2010 and announced it would be effective until Oct. 3, 2011. This announcement supersedes the stay in order to correct potential confusion it may have caused. It also extends the stay until the EPA has completed its reconsideration of the Fugitive Emissions Rule.
