The
EPA proposed to formally remove a paragraph of guidance dealing with releases
due to natural weathering of products, and also an exemption for wood treating.
The EPA on Monday, Aug. 24, 2009, proposed two new exemptions under the Toxics Release Inventory (TRI) program:
1. The EPA proposed to formally remove a paragraph of guidance dealing with releases due to natural weathering of products that appeared in the Reporting Forms and Instructions (RF&I) from 1988 to 2001. This guidance was absent from the Reporting Forms and Instructions after Administration of President Bush took over in 2001, but formal notice of its removal was never issued. The EPA has now made it official; the language has been removed and may not be relied on by reporting facilities.
2. The EPA is proposing an interpretation of how the articles exemption applies to the Wood Treating Industry, specifically to treated wood that has completed the treatment process.
The proposal was noted in a press release and in the Federal Register. The agency is requesting comment on both of these actions. Comments must be received by Oct. 23, 2009
