The EPA announced that they have posted new questions and answers regarding section 8(e) of the Toxic Substance Control Act as a result, at least in part, of recent enforcement actions that have concluded.

This section of the act requires manufacturers to submit information about substances or mixtures that may present a substantial risk of injury to health or the environment. The Q&A provides information regarding:

• Definition of substantial risk
• Reporting procedures and responsibilities
• Persons subject to the act’s Section 8(e)
• Information known to the EPA Administrator
• Health, safety and environmental effects
• Environmental contamination
• Reporting of modeling and risk assessment studies
