EPA Withdraws Direct Final Rule on De Minimis Submission Loopholes

On June 1, 2006, the EPA announced its decision to withdraw the direct final rule amendments to the PM2.5 De Minimis Emission Levels for General Conformity Applicability rule published on April 5, 2006. The EPA stated in the direct final rule that if the agency received adverse comment, it would publish a Federal Register notice withdrawing the rule. Subsequent to issuance of the rule, the EPA received adverse comment on the direct final rule and it is therefore withdrawing it. The agency is not instituting a second comment period on the action.
